Britnett Derbyshire Terms & Conditions of Business
These terms & conditions of supply, service and support apply to all services and products provided by Britnett Derbyshire. Any and all work carried out by Britnett Derbyshire is done on the understanding that the customer has agreed to these terms & conditions.
We will provide a written quote before commencing with any work; the quote will be valid for 28 days from the date on the quote. If the customer requests additional work to be done which is outside the remit of the quote, we will provide a further quote before proceeding.
All monthly hosting, SEO ("search engine optimisation") and online backup payments are payable by standing order on the first day of every month. No alternative method of payment will be accepted for any of these services. For all monthly services, our aim is to retain customers by the strength of our service, not by the length of a contract. We do not tie anyone into a long term contract, all that we ask is that you ("the customer") give us 30 days written notice should you wish to cancel.
Domain Names and Email are provided on an ongoing basis to ensure continuity of supply. We ask that you ('the customer') give us 30 days written notice should you wish to cancel.
All and any other work provided is payable against invoice, with payment due 14 days from the date of invoice. Payment methods accepted are by online transfer (preferred), cheque or cash.
If the customer does not pay in accordance with our terms, Britnett Derbyshire holds the right to suspend either work in progress or services (whichever is applicable) until payment has been made. Any consequences of products and services being made unavailable as a result of late payment are the full responsibility of the customer. Whilst we do not like having to chase customers for payment, we will use a Debt Recovery Service where payments continue to be late. Any and all fees and costs incurred in recovering the debt will be payable by the customer (this includes the addition of an interest charge according to the Late Payment of Ccommercial Debts (Interest) Act of 1998).
The monthly fee payable for hosting includes an element of support which entitles you to reasonable assistance with updates to your website. For more significant changes, we will provide a quote for an additional charge.
Britnett Web Services will back up a customer's site on a daily basis. This backup will be stored off site in case of fire or theft. In the case of failure of equipment or networks, we will make best efforts to restore the connection to the web as soon as possible. All backed up data is lost after a period of two weeks. It is the responsibility of the customer to keep a back up copy of any information added to the web site.
We will host your site and make best efforts for it to be available on the World Wide Web. The World Wide Web is comprised of many networks and connections outside of the control of Britnett Web Services and we can in no way guarantee availability of a site at any time.
Neither Britnett Derbyshire nor Britnett Web Services cannot accept any liability for attacks on the customer's web site from viruses, hacking or any other third party attempt to disrupt the normal working of the web site.
Limitations of Service
Whereas Britnett Web Services make every effort to make web sites hosted by them available for the maximum amount of time, the servers will be down from time to time because of routine maintenance and failure of operating systems software. Britnett Web Services do not guarantee that the web systems will be available at any particular time.
You have the rights to the content of the website, but not to the underlying systems that support it.
SEO (Search Engine Optimisation)
Britnett Derbyshire shall not give any guarantees on the outcome of promotion of a domain name and web site to search engines. If a web site does not appear in a search engine for any reason the company will in no way be held responsible.
Domain names can be purchased on behalf of customers. It is the responsibility of the customer to ensure that a domain name does not infringe any trademarks or copyrights and indemnifies us against any action that may be taken to recover a domain name. The transfer of a domain name and any cost ensuing including legal cost will be the responsibility of the customer. Ownership of a domain name will be registered in the customer's company name.
The Customer Agrees
The information that you give and make available on the web both now and in the future is accurate and not in any way false, defamatory, libelous, indecent, obscene, misleading or offensive. We retain the right to remove any information which we consider not accurate and in any way false, defamatory, libelous, indecent, obscene, misleading or offensive.
Your business and any other materials or information you provide to us do not infringe any law, regulations or rights including the intellectual property rights of other people or organisations.
Not to use products for any illegal or improper purpose nor allow others to do so.
The systems and pages designed to a customer's specification must comply with various differing country regulations. The customer indemnifies us against any action that may be brought because of infringement of regulations of another country.
It is the responsibility of the customer to ensure that they have the right to use any and all of the material on the web site.
The customer is responsible for any final checking of content and user functionality before systems go live. Britnett Derbyshire can in no way be held responsible for any consequence of a site not being checked before it goes live. It is the responsibility of the customer to adequately check the site to their own satisfaction.
Where email is provided the customer agrees to not use or attempt to use the account to send unsolicited email or "spam" in any way.
Images on a website must have the correct rights to be used. Images can be sourced in a number of ways:-
We shall be under no liability if we are unable to provide any products or services for any reason beyond our control, including but not limited to acts of God, legislation, war, fire, flood, drought, failure of power supply, mechanical breakdown, lock out or strike.
Both parties agree that these terms and conditions shall be governed by the laws of England and Wales.
